In May of 2002, my mortgage company notified me to make payments to another address, because of my bankruptcy. I was not in bankruptcy. A call to the mortgage company cleared up the error, and they reported to the 3 CRAs the correct information on July 1, 2002. Experian and Transunion complied. However, during our refinancing, it was discovered this information is still on the Equifax report. My mortgage company followed up with a fax and letter in April 2003 telling them the bankruptcy had been submitted in error. I was told today by Equifax that it can take up to 15 days to respond to a fax, and 30-90 days to clear this information from their credit file. Our refinancing is held up by false information. What recourse do we have? How long does the law allow them to keep reporting false information?
