Thanks for the advice. Actually, we did know it was sold years ago and that we owed a remaining balance, but we only received on letter and that was it until now. Actually, I have not received the summons yet. What had happened was that someone called my husband at work (we were both on the car loan) and said they were on their way to serve him with court papers. They said since 9/11 they had to call first and they would be at his work in 45 minutes. Then they gave my husband the 1800 number to call, the hubby notified me, and I called them at the 1800 number. First they had no clue what it was for. They said something about a bad check, that is on my husbands credit report, and something about sueing for fradulent business practices. The CA said they could cancel the process server if we made payment arrangements with them. I asked the date of the proposed collection. They gave me a charge off date of 3/1997, and I explained the SOL had expired and they got off the phone really quick after that and the process server has not showed up and it has been two hours now. How strange, huh? Would a process server call you before you are going to be served?
