It sounds like you have a good case for getting this set aside/vacated. The earlier you act the better. So, glad you're taking care of this right away.

If this really is on a debt that is uncollectable, you should see someone about suing them for abuse of process; unfair and deceptive practices; and violation of the FDCPA. You need to get a copy of your credit report and see if they have reported. If they have, get that taken care of too and include FCRA violations against them.

Of course, you need to talk to a New York attorney about what is possible for you.
