The first thing you need to do seriously is get a tape recorder. You said he sent a letter? Did it have the mini miranda on it. Did it give you 30 days to dispute the debt? Did he state which date he would sue on if you did not pay. What you need to remember is that attorney or not he is still a debt collector and must obey all laws. How much is this debt? Get that tape recorder hooked up right away. I would call him up and ask him for a fax # to send a dispute in. You do not need to tell him why. Ask him when he is gonna file suit if you do not pay. Get this on tape. I would have a validation letter ready to send before you even call. Immediately after you call if it goes bad fax out the validation letter. They cannot obtain a judgement during the 30 day validation period. When did you receive this letter? that is the day the 30 days start- not the date they sent it. Be prepared.
