Why not appeal? This is a scumbag trick pulled by one of the sleaziest collection agencies in the book, relatively speaking. Right, it is like trying to decide between tertiary syphillis and ebola, but still, AssXXXX crAccept-ic Crapo-ration is considered the low standard by which other aspiring predators are judged.
Their website should be mandatory reading for any and all taking out credit cards, it tells you precisely the ilk with whom you are getting involved and no amount of air freshener, de-lousing agent, or even De-Germ (r) can negate the stench of self-satisfied avarice given off by this pheromone crazed pack of rabid lemmings.
This written vs. oral ploy is played up in Florida also, another state apparently owned by banker sleazoids. Sounds as if you had judge Dog-track on the case, old friend no doubt of the banker/CA scum. Hey, it's tough keeping up two Lexuses and those country club dues...and all on a judge's salary. So helpful, those bankers.
The credit card is an open account, the CA is just flat out stealing more time on the statute and scream to the FTC about this. THey have a full head of superheated steam due to their justified extermination of National Check Control, strike while the iron is hot.
And if all else fails, yes, bankruptcy is option of last resort. DEprive these demented cockroaches of their money-fix. Notice the much threatened BK reform legislation still isn't out of its toilet-hatchery as yet. Apparently even the banker cow-pops can't purchase enough legislative horsepower to overrule common sense and decency, thus ever should it be so.
We are all pulling for you, there's nothing that can't be done.
