I live in GA. In January 2003, one of my cc raised my interest rate because of something on my credit report. I received copies of my credit reports and noticed a collection $255.00 was placed there. I sent out a request for validation. On the same day, after I had sent out the request for validation, I received an envelope from the CA that contained copies of 3 months of statements, and nothing else.(no letter demanding payment) The statements had my name on them, but an address that I have never used nor lived at. This debt isn't mine.

I waited 30 days, and didn't hear anything from the CA. I sent out a second request for validation. Again, CA has not responded and has not removed the entry from my credit reports, which I demanded they do if they did not validate. I figure it's time to sue.

I live in a rural area, so I'm certain I will have to educate the small claims judge on the law. Since I have never filed suit I need help with writing the complaint and finding case law that pertains to my situation. If anyone can help me, please email me at ikya@muchomail.com
