hi, back in 96, i lost a house to forclosure... balance was paid for at the sale however the equity loan was not paid in full..huntington bank (equity loan) got a judgement in 97, never heard a peep from them.. now a few wks ago, a receive a "motion for revival of judgement" which i quickly objected to... in ohio they only have 2yrs to collect a deficiency (same for repo of car).. anyway now there is a hearing set.. what should i expect. the debt collector is weltmen, weinberg, and reis... the ohio revised code that i am going to use is 2329.08... it should also be known that huntington charged off this acct in 98.. and lastly, i went to the courts to see the file and lo and behold it is currently being transferred to microfiche so it is not there and they dont know when it will be back.....how can i have a hearing without evidence in my hands?? do you think the ca will show up.. they know i am going to use the ohio revised code to fight.. any suggestions...
