Yes they are in violation of the FDCPA. Contact an attorney and as Keyser said. Report to their states attorney general and contact the FTC. I would look in the Yellow Pages under credit attorneys and tell them you have the recording and you want to sue. They'll take the case immediately. They know they can big bucks for that after the company settles.
