Lawyer or not, he's still a debt collector and bound by the FDCPA. If he's threatening to sue and has no intention to do so or doesn't have the authority to do so, then he's violating the FDCPA.

If you're going to offer to settle, put it in writing and get ALL the terms you want, including any payment plan for the remainder. You also want to make sure that all CA entries are removed from your credit report. Do not pay them a dime unless and until you get a SIGNED agreement !
