Looking at an old CR looks like 5/99 was the last payment to OC. CA sent 4 statements 2/00 - 5/00 showing a phone payment on 3/00 other than that no activity on acct except the late/overlimit charges. The bottom fell out for us in 99 so all credit card use was stopped at that time and no payment to any of them was made in 2000.

He did not enclude any signed application with the summons only a generic agreement which is dated for 2001. Since the CR shows the account was closed in 7/99 will the 2001 agreement hold up? I imagine they want to use this one since it clearly has the Arbitration clause.

The reason I became confused about our statutes is Friday I called a local Bk atty who told me that it didn't matter if I was not joint on the account our property was subject to lien. He gave me a number to call which I thought was an agency to help me out, wrong some used car type guy ans the phone and when I asked what the co. was he said "Budget Finance". I couldn't believe it I had just told the Bk atty we living hand to mouth, credit shot what would make him think anyone even this shister would give us a loan??? Any I did call another BK Atty but he pretty much told me the same as the first one.

So I totally stressed out and went back to reading the statutes only to get more confused, began to wonder what I was missing. Yes with your "How to Ans a Lawsuit" I feel I can get my answer in OK.

Yes I visit your web site often. So much information there. I have benefited many many times by the information you and others here have so freely provided on these boards.
