"Latches"

Working on answer and need an opinion.

The plaintiff threatened to sue me last year over this debt but is just now getting around to it. Would I be able to use "Latches" as an affirmative defense, or is this stretching it?

Also am kinda stuck on answering the last paragraph of the complaint. Plaintiff is asking the court to reserve jurisdiction in the final judgment for making subsequent fee awards etc., and his money claims for relief.

This is how I've got it now: "Answering paragraph 14, defendant realleges and incorporates by reference the admissions, allegations, and denials in paragraphs 1 through 13." Scratching my head here, so any comments or ideas will be most appreciated.
