Three weeks ago, I received a 'Final Notice' letter from Discover Financial Svcs. informing me that my account will be sent to their recovery unit and the Charge Off date was stipulated as May 30. Since I have no job and have health problems, there is just no way for me to make any arrangements to pay their demand for minimum payment. Today, I received a letter from Discover Financial Services with the bold reference on 'Attorney Placement Pending' and they basically indicated that they are authorized to proceed with 'legal action'to secure the balance ($8,000+)they claim I owe them. If they do not hear from me within 10 days, they will forward my account to an attorney to obtain a judgement against me. I am a homemaker, unemployed, have serious health problems and the few assets that I have are NOT solely on my name alone. I live in Delaware, and our home of 5 years have little equity and we have a First and Second mortgages on our home. Our joint bank accounts/car have my spouse as the primary name. I have always been diligent with my credit card payments till 6 months ago. But due to circumstances beyond my control, there is just no way for me to make payments anymore. My questions are: 1. what can they take from me in the event they sue and obtain a judgement? 2.Why would they say they will charge me off and then all of a sudden threaten me with legal actions? 3.Can they put a lien on our home or garnish my husband's salary? 4. Can they take away our car that has been paid for already since 3 years ago? Please...I need all the information I can. Thank you, thank you for taking time out to consider this plea!
