There is no guarantee that the ca will get the judgement. Have they filed suit against you? If not, they may not do so. Keeping a low profile as regards entries on your credit report is a good idea, live apart from the credit economy.
If you are being sued, by all means show up. if mediation is available - usually for small claims, and here in FL a total sham - you would be well advised to sit down with the mediator. There is no law that says you have to agree to their demands, you don't even need to admit to your indebtedness if in fact you even are in debt.
Pre-trial conferences are about each side eyeballing the other. Let them do the talking and be careful how you answer them, if you choose to at all. This is their picnic, let them provide the sandwiches.
Sometimes answering the suit, not making any admissions, and filing simultaneous complaints with FTC and state AG serves to discourage them from further activity. Many times a creditor drops a suit already filed if you indicate you are more trouble than you are worth.
If sued you answer their charges by claiming 'lack of knowledge'. This is standard, after all they brought the action, let them prove their claim. It's not your job though they'd love for you to do so.
Sometimes that answer alone will send them along to the next target. Sometimes they will linger, like the fragrance of rancid B.O as given off by someone with end-stage cirhosis. They might send you Interogatories and Requests for admissions and Production of Documents to prove your case. Answer them as the local laws dictate. What they want is for you to again, prove their case for them, thus saving them considerable time and expense.
Theirs is a numbers game. This vermin buys dead accounts for nothing, and they will even spend a couple hundred dollars in filing fees to sue you if they think you have something to take. They will walk away from that if it looks like you will cost them money. All they need is to win one of a hundred cases filed, or just keep haranguing debtors via the phone, and they are in the black.
You are absolutely right, settling with these termites merely prolongs the agony. They sell the - ha ha - forgiven balance to some other scumbag who starts the harassment afresh.
Worse comes to worse, move, sit tight, again cost them money. They are hateful rot and you will sleep better secure in the knowledge that you have denied the ilk of the trolls on this board their much needed crack 'n bimbo funds. Let them starve for a change.
