Scott. Thank you for all of this information. It is extreemely helpful. I am concerned, however, with the language in one of the statutes.
" The cause of action shall be deemed to have accrued from the time of the last charge or payment proved in the account."
Since this was a health club, they charged on my account, monthly dues well after I cancelled and quit paying on it. I am afraid that the last monthly dues that they charged me might not come over six years. According to the law, wouldn't time start at the last monthly charge of my dues before they froze my membership? Also, I need exact payment information and there are only two places that have these records; the health club and the collection agency. The health club rep told me they could not print out a copy for me and could not even talk to me. (By the way I talked to her last week and she gave me some payment info over the phone.) Can they refuse to give me a printout of payment history? Also, If they can, can I go down to the collection agency and demand them to copy my file for me? If I can, what law can I use if they refuse. My time is up this Sunday to respond to the summons, so in reality, I have until Friday to answer. I have to make sure that I am in the right on this matter and that I am representing the law correctly in my case. Thank you for all of your help. I don't know what I would do without this site.
