In most cases it is very illegal to tape record a phone conversation without both partys knowing that they are being recorded. (remember the Monica Lewinsky case, she was recorded without her knowledge and without a warrant) Just check with someone who knows more about this before you tape anything. If you never disclose the tape or tell anyone no problem. If you tell anyone especially in court you could be subject to prosecution.

If you get them to agree to be taped before hand no problem. Then after they agree you begin taping and the first thing you do is again state that you are taping and you then have a record that you let them know.
