In a perfect world yes. However, most consumers do not know what the SOL is or their rights so they get sued and lose anyway. Most of them do not even show up to court. You have to show up and use the SOL defense. If you know the law you can countersue them for filing suit after the SOL. However, 99.9% do not know this so the CAs get away with murder.
