i while back i posted about a foreclosure i had in 96, house was sold and paid in full, equity line (huntington) was not paid in full.. in turn huntington rec'd a judgment... about 3mos ago i rec'd from the courts that they filed a motion to revive the judgment.. i filed a objection to this stating ohio revised coded specifically states that a deficiency on a home or vehicle that was repoed can only be collected within 2yrs...(it is 6yrs now), i also stated that my credit report states "charge off paid in full"... well today i recd from the attorney a reply brief in further support of motion to revive judgment stating i showed no proof of the chargeoff, they rec'd a copy of it... they did not mention the ohio revised code at all...they also stated a payment of 907. was received on June 29, 2003 which means they must have a time machine because last i checked today was may 31 2003.. other tidbit is that they changed lawyers within a firm...it is weltman weinberg reis..
there is a hearing set for 6-17-03 but i can't get any copies of the docket because it is being copied to microfiche so i was going to file a motion for continuance...
so do i file an objection to their reply brief? any ideas...
