Hi Lulu,

Affidavit of indebtness is probably a statement of how much the plaintiff (creditor) believes the debtor (defendant) owes on the credit card/contract/etc - whatever is the subject of the lawsuit.

Motion for summary judgement means that one party (probably the plaintiff - the one who brought the suit) is asking the judge to decide in his favor without a trial.

It basically says that there is no issue to be decided and the plaintiff has proved his case in the pleadings and no trial is necessary.

This is standard procedure for debt collection lawyers...

If you are a party to this action, you would be notified of the court date and given an opportunity to challenge the motion for summary judgement.

If you go the courthouse, you can request the file and read the documents to see what they say.
