chase na charge off

chase has an entry on my credit bureaus that goes like this. opened 12/87. updated 11/97. closed 10/97. status 10/97, charged off as bad debt. now i know for a fact that this account was not paid on past 1989. the sol for the state of florida is 4 yrs. is it illegal for them to pop back up and say "charged off 8 yrs later"? how do i get it taken off (of transunion)?
