You cannot sue with no proof. You will always lose a he said/ she said courtcase with a business. Go the validation route. Trying calling the original creditor and either tape it if they are in a 1 party consent state or get something in writing. You have to give them the chance to fix the problem first. Try the BBB or attorney general. they will claim it was a clerical error and you will get nothing.
