You may be sued at any time per Sprouse vs City Credits:

A creditor never has to accept less than the agreed amount and if you wait until a judgment is entered to contest the action it is too late. A default judgment will be entered and the CA may proceed to collect through garnishment, leins, etc. And yes, creditors may refuse payment if it is not in the agreed amount.
