Lets say that one has a collection account in which the original creditor is a Psychiatrist. The consumer report lists his full name as John Doe, MD. Anyone that receives a copy of the report would in fact be recieving a consumer report with Medical Information. Would the following apply? FCRA § 604. Permissible purposes of consumer reports [15 U.S.C. § 1681b] (a) In general. Subject to subsection (c), any consumer reporting agency may furnish a consumer report under the following circumstances and no other: (6) (g) Furnishing reports containing medical information. A consumer reporting agency shall not furnish for employment purposes, or in connection with a credit or insurance transaction, a consumer report that contains medical information about a consumer, unless the consumer consents to the furnishing of the report. Any legal advice would be greatly appreciated. PS. I did the Hippa thing with this Doctor and the collection agency has ADDED an ADDITIONAL TRADELINE reporting the Item Paid. The old outstanding tradeline still reports. Now I have two tradelines for one account. I'M NOT VERY HAPPY.
