It is true that if you were treated before the HIPAA regulations went into effect and there were no NEW exchanges of private protected data, there would be no violations.

However, if you read the "legal basis" for the HIPAA letter, and the follow-ups, you will understand.

Just as HC providers are required to store their "old" files in a secure facility to prevent any access by unauthorized parties, so too, any NEW exchange of information, AS MANDATED BY THE FCRA, would be a violation.
