Yes, they are in violation and can be either sued under FCRA, or have a filed complaint under HIPAA, unless they delete and expunge.

They are in a "catch22" that ONLY applies if there is "NON-permitted" divulging of private health information after 4/13/2003.

This includes "verification" or "updating" of credit reporting, (they are REQUIRED under FCRA to have ONLY accurate information reported)

I discovered this WAY prior to the enactment of the final HIPAA rules, which is why I was able to get the "method" on my website that quickly.
