Divorce decrees mean nothing to creditors. Whoever's name was on the mortgage is who they will come after to be paid.

If you include your Ex and the now UNSECURED mortgage loan is discharged for you, YOU will have NO liability and your ex CANNOT come after you for it either. By including your Ex, you completely prevent him from ever coming after you for the debt.

As for how you list it.. since the house was sold, its no longer a secured debt, so you list it as an unsecured debt. When you list your Ex, mark it as CONTINGENCY, that means it has not happened yet and it may not ever happen.
