How do you prove hardship, is it extremely difficult? I have read you can include some taxes and student loans in bk13 as long as they get paid off during the time you are making your payments. But, if we did file 13, would the student loans be able to garnish during our repayment period, before it is finalized? They are currently not garnishing through Administrative wage, with the 10 percent, they have a judgement and is garnishing that way. Don't know if it makes a difference or not. They won't let us do the refinancing because there is already a judgement in place. Thanks for the help and I will also check out the links on your site.
