First of all don't worry.....I have over 70K in credit crad debt, have not paid on them in 8 months, also they are all charged off...collections sent letters I sent cease 7 desist letters, they sent more letters, I sent validation letters, they have to prove that they have a right to collect, & they have to have a copy of the original signed by you agreement, also, a record of all charges, not a computer generated copy....so as time goes by & you don't pay try & get your mortage current, once mortgage is current file CH7...only if your exempts are enough not to lose the house or car, like NC has 10K exemption for house so if you owe say 75K & the house is worth 85K you are ok....if not file ch13. & pay back 10-25% of all of the unsecured balances, your mortgage would have to be paid by you, but if you are behingd the behind payments would be added to the ch13...write me, if you need more info, believe me I am in a worse situation...jo.
