See a good Bankruptcy Lawyer. If you are that far in debt and the house is in foreclosure or pending foreclosure, you need to do a Chapter 20. That is a Chapter 7 and Chapter 13.Filing the Chapter 7 first will freeze (temporarily) a foreclosure action and at the same time the chapter 7 will eliminate most of your unsecured debt. Once the Chapter 7 is discharged by the court, the bank is now open to starting foreclosure proceedings. This is when you file a Chapter 13 which will allow you to pay off mortgage arrears and other secured debt thru a repayment plan.
