CA appealing court decision ....so back to court

Hi all

This is my first post but have been here alot gaining valuable information. Thanks to all that post here for the great information.

I went to court last week to defend against a civil suit from Sears. The other attorney never showed and I won by default. Prior to the court date they tried several times to offer me a settlement. I continually refused and told them I would see thme in court using a SOL defense. Well....never did see them in court.

I recieved an envelope yesterday containing an Intent to Appeal from the county courthouse. He now has 20 days to enter a complaint to get me back in court.

Is it too late to hit him with a validation letter??? I have read that he cannot pursue a court case if he can validate but I may have dropped the ball by not doing that first.

Any other ideas???

Im preparing (basically saving money and interviewing attorneys) to file chapter 7 in the next few months but would prefer to beat this before I file.

I will look for chargeoff date on my Experian report and will post that tonight.
