I cannot speak to their non-response to the Court, nor do I wish to get into the details of your case against them, I am not "into" that area of the law, however, on the tolling issue, tolling is a "time-out" from the SOL. For example,
1- Start of 4 year SOL 1/1/1997
2- Start of BK (filed) 1/1/1998
3- BK dismissed ......1/1/2001
4- 4 year SOL would be-1/1/2004
