I do not know about your SOL issue's. However, this is what I would do and have done several times this year. I would respond with a letter demanding validation. If they do not respond within 45 days max, have their registered agent served. The cost varies from state to state but is typically between 35.00 and 50.00. It has been my experience that upon receipt of your summons, they will call you and want to settle provided they can't validate. It's not likely they can validate because of debt being so old. Then settle for complete deletion along with half of the $1000.00 penalty or you won't dismiss the lawsuit. Don't dismiss until you get their response in writing. Remember at this point you are in control. Find out if they purchased this accout from the OC or if they are the assignee. If assignee, ask to see a copy of the assignee's agreement/contract with the OC. If purchased, ask to see a copy of the bill of sale from the OC. If they can't or won't produce, then you may be negotiating with a company or individual that does not have the right to collect the alleged debt.
