Three months and already in collections is fast for a OC to place an account. All hope is not lost. If I were in your shoes, I would be looking for a way to possibly offset the alleged balance you owe to the CC. What I mean is, if they don't abide by the C&D and If you disputed the debt and they didn't report it as disputed, you then have two FDCPA violations worth 1,000 ea. to possibly offset the alleged balance. By the way, I believe you should validate this debt to make sure there are no surprises on this account and if they don't validate within the time allowed, you have another violation. I did this in the past for a friend and it worked very well for him, as it zeroed out his debt with no out of pocket. I'm not saying this will work for you, only what I would do if I were in your shoes having sent out a C&D letter.
