I have a collection attorney calling my neighbor claiming my phone has been disconnected. They also called me and left a message telling me they would call a few of my neighbors to have them get a message to me, just in case my phone was "broke".

I'm in SC. The last payment was 1/02. Should I send them a letter pointing out their violations? Should I send a validation?

I have drafted a letter pointing out the violations with the statement that further violations will be reported to the FTC and my local AG office. In the same letter I am requesting full validation of this alleged debt. Now I would just like a bit of advice as to whether I should send it or not - I don't want to kick off a lawsuit.

Advice please?

Go ahead and send it. Reminding them of their violations of the FDCPA shouldn't be a problem and it will even let them know that you're not one of their usual uninformed consumer 'victims'.


I clearly stated my last payment was 01/02. Obviously within SOL - or do I specifically have to say it's within SOL

Where's the misunderstanding here?

You don't "believe ANYONE on this forum would suggest using such tactics", yet they did - the thread is still there, I didn't make it up.
