I am still in need of some assistance regarding my original posts on 6/20/03 and 6/28/03:

We had digital cable and high-speed Internet through Comcast when we were living in Maryland (serving on active duty). When we moved back to Michigan, we were told to return the digital unit or we would be charged $450.00.

We shipped the digital unit and modem to Comcast via UPS. The shipment was sent through Mail Boxes, Etc, on 2/21/03 - about three weeks after we got to the new place. We got a detailed shipping receipt and shipping insurance, but my husband forget to put my name as the sender instead of his, though we put my account information on and in the box (I changed my name right after we moved).

We got delivery confirmation through UPS tracking, and it shows that the unit was signed for at approximately 10:35 am on 2/26/03 (the Comcast collections rep said the signer was a receptionist). The woman at Comcast told me she would call me back, but I never heard from her.

I faxed my UPS proof of delivery and shipping receipts to both the CA and Comcast, and I sent a dispute letter to the CA. However, we received another letter from the CA stating that they had contacted Comcast and the debt was still valid (even though we sent the documentation). In addition, they reported both of us to all three of the credit bureaus (the CB’s also said it was valid despite the proof I sent).

I filed consumer complaints with the Maryland attorney general, the FTC, and the Better Business Bureau, and notified the OC as much when I sent a follow-up fax on 6/30/03.

If the mediation those agencies provide doesn't get us anywhere, can I take the company to small claims court? How does that work if I am a resident of a different state?

What would make them say the item wasn't received when they in fact signed for it (and never mentioned that they didn’t receive the modem, which was in the same box)?

State of residence: Michigan
State supposed debt occurred in: Maryland
Age of debt: 5 months
