I have received a court summons in which I am being sued by Direct Merchants Credit Card Bank. I have tried contacting the Bank to resolve this issue. I was told that they no longer had this account that they had sold it to a collection agency. Please tell me what steps I can take in this matter. I am suppose to file a written answer to this summons in 35 days. It also said if I had and dispute in the validity of the debt wo wend a written notice to the law firm within 30 days. I have spoken with a debt collector within this law firm(you may not speak to one of the stated attorneys on the letter head) in which he tried to get me to pay as much as possible on this account before it went to court. I refused. He then began to tell me that in his experience that the court would award then the judgement plus attornies fees with the average 25% withdrawal from my check. I have several things i wish to dispute but can't afford an attorney. I tried to use a debt consolidation but the refused. The Apr rate was 29.9%. I refused to pay this amount. I wanted to set up payments with a lower rate but was told they couldn't do this...Now, I am stuck with a collection agency that is in the processes of taking this case to court. Please give me as much information that I can look up or obtain to defend my rights against them. I feel that that are misrepresenting themselves in the lawsuit stating the plaintiff to be Direct Merchants Bank, since the account was sold to them. Please help. Confused and Mad in OK
