I thank you for all your comments. I do know that I do not quilify for the SOL. My account was in good standing unil 2002. I do have one more ? though. When I reply to the summons and the collections agency, should I include the information I've obtained with the settlement that DMS gave in a lawsuit? The final judgement in the case was 2002. The lawsuit contained the the issues of their high interest rates. I also wish to prove that I attempted to pay my account through a credit counseling agency. Could I offer to the court and the collections agency to resubmit the offer to pay this account with a lower apr? Will the court read the written reply and determine that there is no need to set a judgement on this account? Can the court or will the court make a judgement based on my offer to pay the account at the lower rate? Do you have any advice on how to offer this and at what rate would the court and collections agency agree on? Thanks for takin the time to read and reply.
