JUDGEMENT WITHOUT NOTICE

I wrote before about opening a closed charge account. Interest was being charged to the account from the Credit Card company after the account was charged off and date change (re-aging?) resulting in a judgement. Someone asked me if I was served and I didn't understand. When I received in regular mail, a Notice to Garnish my Wages, I thought that WAS being Served. The Notice to Garnish indicated I had 10 days to respond. I did respond within 10 days with no reply from the Collection Agency. I received Notice of Garnish (nothing else) in February of 2003. In June 2003 my check was garnish. I've had no correspondence with the Credit Card company or the Collection Agency since my last statement activity in 5/97. There was no Summons or Court Appearence sent in the mail just the Notice to Garnish. I went to court to get a Motion to Vacate Judgement and get copies of the file, thats when I found all the paper work for the judgement. Paper work I never received. Is this legal????? Thanks for your help.
