I am married, but have $30,000 in individual unsecured credit card debt. I am being sued for $15,000 by one of my creditors, so I was forced into this decision. I want to file bankruptcy individually (husband is not, nor ever has been on these cards), but we have a joint Home Equity loan (not filing on joint accts, only mine - the house is in my husband's name ONLY, and has NEVER been in my name - he owned it before we were married) . Will there be a problem with the bank that issued the HE loan when they find out I filed bankruptcy? I have no income, all income comes from my husband - we are current on all our joint accounts, it is just mine that are trashed (due to job loss). Filing individual bankruptcy is going to be the difference between being able to manage financially and going into the toilet - I just want to make sure I don't lose my home. I'm in NJ, I've consulted a lawyer already who said there is no problem - I trust him, but just need to hear personal experiences/horror stories before I sign on the dotted line - thanks!!
