Whatever you do, if you are going to file a BK for sure, stop paying the credit cards. Inform them that you have consulted with an attorney for a chapter 7. Check to see if the attorney will take a payment plan. My wife filed about 8 years ago and she says her attorney took half when he started working on her case and the other half at the meating of creditors. I'm sure they wouldn't try to sue if they know you will file a chapter 7 anyway.
