Scenerio: I co-signed on a $500 credit limit card from MBNA in 1991 for my college freshman daughter. This act of benevolence was long forgotten when I started receiving dunning letters in 2002 from Risk Mgmt. Alternatives that I owe $9430.05. It appears that over the years the credit limit on this card was raised exponentially to the point where my daughter (and her new husband) was tempted to max out the limit. Along with a few other cards they had.
They filed for Chap 7 BK in 1999 and this debt was discharged. While they apparently dogged my daughter for payment prior to their filing, I did not receive any communication that the card was delinquent.
BTW, the debt was charged off by MBNA as of 6/1999; was apparently picked up by NCO as assignee of MBNA; then on to RMA.
My question is, does the discharge of the debt thru' Chap 7 carry thru' to me as co-signer? Is there recourse? Any advice would be greatly appreciated.
