AAAh Keysor if I could but slay the Dragon, what sweetness that would be! But alas me thinks me is only dreaming! LOL

The guy knows I am way out of my league and he is pounding me with "Admissions, Written Depositons, Production of Documents moving to strike my counterclaim and motions to the court to deny my motion to dismiss Arbitration.

I actually thought I had won the motion to dismiss Arbitration since I got notice from the court the matter would be heard and that we should select a court date. But today I got notice that the judge upon being fully advised has denied my motion.

If I can't get him to reconsider then I am stuck and will just have to let the CA get the judgment and then appeal. No way I can come up with the arbitration fee and if you don't pay it within 10 days after selection of the arbitrator then you are not allowed to participate.

At Whychats site I found a link that took me to a recent decision by the 9th District (my district) on Arbitration and AT&T in short "The district court declared Arbitration Unconscionable"

So I am wondering if I can use this case to get the judge to reconsider.

I thank you for responding and know what you say about these people is correct. Its like fighting the Borg "Resistance is Futile" so don't try to get your day in court.
