Well, that's worth a shot.
Demand validation and ask for a copy of the app because you never filled out an application and you suspect fraud.
Of course, respond to the lawsuit with a denial and the ID fraud allegation.
Did you ever use the card yourself? If so, if they've receipts with your signature or, the statements were coming to your address for a period of time, this'll be a tough sell.
