Court Summons

I came home the other night to find that a summons was issued from Asset acceptance for First Usa Bank visa. My debt is in the amount of 6,100 and the date on the Summons is june 17, 2003. After reading this, it says that I have 30 days to respond and I received this over 30 days from that date. Can they do this? I am In New York State.

Also, I have 2 prior judgements agaisnt me. I with Chase and the other Discover. I owe around $3,300 on the chase account and $6,500 on the Discover account based on the judgments awarded. I have been paying the sheriff on the chase account to avoid garnishment at a current full-time job. Discover has been garnishing my checks from a small part time job I had at a restaurant that I still work at, but only from time to time. They have been garnishing now for about 4-5 months. I think they "must" notice that I go 3-4 weeks before they get $$ as I only work there from time to time.

Now, 2 questions:

1. Could Discover try to garnish wages from my full-time job if they already are this part time job? (I keep the job open just for this reason) or will they possibly seek to find out if I work elseware?

2. Will a bankruptsy stop these judgement collections?

Is bankrupsy sound like my only option at this point to avoid further garnishments? Ive been trying like hell to avoid this but I seem to be getting deeper and deeper behind.

My full-time position was a long journey and I do "NOT" wish to jeopardize it with collection/garnishment phone calls. This is a real fear of mine. I also fear bankrupsy not only because of the long term effects 9Even if ive damaged it enough already), but also because its public.

Any suggestions would be great!
