I have to agree with WhyChat and JR on the bankruptcy. I think your lawyer sold you a bill of goods when he/she told you you couldn't do a Ch 7. I'd also be willing to bet that you SEVERELY underestimated your 'normal living expenses' - single biggest mistake people make. Normal living expenses is more than Rent, food, utilities, gas and clothing. It INCLUDES normal auto maintenance, including registraion and licensing fees, bank fees (monthly maintenance fees, checks), dry cleaning, shoe repair, insurances (car, renters etc.), medical expenses (co-pays etc.), personal care (hair cuts, cosmetics, etc. -women have more than men in this category), household maintenance (even if you rent, you buy lightbulbs, clean the carpets right ?), birthday and holiday gifts, magazine subscriptions, club memberships, professional dues (if any) and even entertainment and recreation (within reason) and pet care if you have any.

Get my drift here ? The list is a LOT longer than I'll bet YOU had to start with. The two of you need to sit down with your receipts and checkbooks and go over EVERYTHING you normally spend money on day to day, month to month. Things that only come up once a year or intermittently you need to average in to get a monthly number. Make a list, average it out and then put that up against your monthly income. Include car payments too. NOW subtract this list of expenses against your income and what are you left with ??? I'd be willing to bet that disposable income number is a LOT less than $1000 !!!
