Hi I posted a while back regarding my mother beign sued by Asset Acceptance here in Florida. she is beign sued for a providian credit card which had a limit of 500 dollars and they are suing for 1214.00 plus court fees. My mother has no paperwork to prove that the amount owed was 500 and that the debt is more likely older than four years.
Originally the pre-trial was scheduled for the 8th of July but we got a continuance for the 31st of July. Now Asset Acceptance tried to get a motion to appear by telephone because they are saying that it costs them too much to appear but the judge denied it. SO the pre-trial is set for the 31st. I will be there with my mother because she doesn't speak english, so I will be traslating.
questions:
1. What should we do if they still show up? how can I ask them to validate the debt? what should we say and what should we not do or say?
2. if they don't show up, can I ask the judge to dismiss the case?
3. Is anyone familiar with Asset Acceptance?
4. If they do win, what could happen? my mother is unemployed but the house we live in in under her name even though there is a trust on it

Thank you so much I really appreciate your help

LM
