They are thieves and scum. They file time-barred (past SOL) lawsuits against helpless victims like your mother.

If you used the material from my website, (how to answer a lawsuit) you filed an answer and notice of appearance,preventing them from their usual sneak default judgment.

Get a copy of your mother's credit report, (preferably Experian) to see how the original Providian account is being reported.

Look for the date the account is sceduled to be removed, deduct 3 years, that is when the SOL is up.

Make sure you PRINT OUT and bring with you the Florida statutes from my website, and the TILA statutes from the "How To Answer A Lawsuit".

Make SURE you INSIST that the account defaulted a LONG TIME AGO, and require Asset to PROVE that it belongs to your mother, that they can prove the amounts they claim ,and MOST OF ALL that they have proof to refute her ABSOLUTE DEFENSE of the account being beyond the SOL.

If they DON'T SHOW, make sure you request a dismssal WITH PREJUIDICE, and ask for sanctions against the lawyer for filing a time-barred claim.

There is NO WAY they can win if you fight them. And since your mother has no assets and her income is all exempt, there could be NO way for them to collect anyway.
