Dear LM - These chivatos from AssXXXX have once again stuck their hooves intheir mouths after walking through a pasture stuffed with mad cows.
They re-aged the debt apparently, trying to buy a little more time to sue. Call the Federal Trade Commission today, now, start a FDCPA and FCRA complaint against them. They claim a payment was made which never was? Another violation, this is outright fraud, again they are trying to buy time so as to sue you anytime they want. This is bad business and will cost them.
File the letters with AssXXXX as WhyChat recommends. Your home is inviolate but you don't want them gaining a judgement, that just gives them license to make trouble for you for the next ten years. It sounds like they are in a fair amount of trouble now over their re-aging of the debt. AssXXXX is famous for this.
You make last payment on a card in December of 1996 for example, you miss January of '97 thus your date of default. Six months later the debt is charged off in June of '97. AssXXXX, the Louse that Rufus built, buys the account for two wooden nickels in January of 2003 and hey, guess what, they tell the credit reporting agencies that the last activity - default date or last payment - was same as when they grabbed it. Totally illegal and this will cost these five-eyed gusanos, see to it that it does. Picking on your mother.
Now, contact the police about this. Many times collectors prey upon the elderly. They are frail, frightened, easily convinced of lies and would rather pay a debt not theirs than experience any more harassment. If you look up the Florida Statutes it's apparent these rotten, unwashed slimbags at AssXXXX and other scumbucket CA's dance perilously close to Exploitation of the Elderly, if not actualy crossing the line. Because it's not reported, the cops can do nothing. REport this, keep after the police, this happens all too often and with disturbing regularity in Florida for some reason.
I don't want you to compromise your location, am curious, if you wish to reveal such, are you on the east or west coast? Reason I ask is that this Rodolfo J. Miro gets around, always on the move. There's an amateur radio operator by that name in the Daytona area according to records, though Miro operates out of various toilets around the Coral Gables area, never in one powder room office too long.
