I have some questions about filling out a form so I can file a motion to reopen my bk case tomorrow. LadyNRed has been a HUGE help. Thank you so much. I'm going tomorrow so I wanted to try to get some assistance from anyone who may be familiar with this. I have a sample letter filing a motion to reopen. I had a question about that. My reason is to "bring an action for Contempt for violation of the injunction of the discharge by continued collection activity" but the sample form also says: ----- Debtor anticipates that within twenty (20) days from the date of the Order reopening the case that she will file an adversary action with the Court seeking the determination of the dischargabilities of the above-referenced claim. ----- So how do I change that to fit my situation? "file an adversay action with the court...??" I don't really understand what that means. Also, on this sample letter (at the end):
---- 20 DAY NOTICE If an objection or pleading is not filed with the Bankruptcy Clerk within twenty (20) days of service of this Notice upon you, I will present for the Court’s approval an Order granting the relief requested. CERTIFICATE OF SERVICE The undersigned certifies that a copy of the foregoing was served upon (Trustee's name and address goes here); (other parties of interest and their attorney's name and address goes here) U. S. Trustee, (address of your local U.S. Trustee); this _____ day of August, 2003, by regular, postage pre-paid, U.S. Mail. ________________________________ Attorney or Client Name (Attorney Bar #) Attorney for Debtor(s)
--- --- --- --- --- --- --- Are these on separate pages? Or are these part of the motion I'm supposed to file tomorrow?
