The Contract that I signed says my debt is with Mazda (creditor), it doesn't say Mazda and assigns, or debt collector. Per FDCPA...
"Creditor is the one who offer or extends credit creating a debt or to whom the debt is owned, but such term does not include any person to the extent that he receives an assignment or transfer of a debt in default solely for the purpose of facilitating collection of such debt or another." Is Mazda American Credit the same as Ford Motor Credit Co.? Plaintiff is Ford Motor, but they put with handwritting in the lawsuit under Ford's name D.B.A Mazda American Credit. Contradictory issue for me since the lawyer states in the Complaint that plaintiff purchased the Contract. Did they purchase, or Ford is B.A Mazda?
