I went by the court house and asked what had been filed on my lawsuit. The only things filed was the summons from the plaintiff and my answer. I asked about the requests for admissions and interrogatories, I was told that it did not have to be filed at the court house, however, I must respond. I do have a question for you. If in the summons it states that if I dispute the debt or request name and address of the original creditor in writing all collection efforts, including this lawsuit will cease until we send the requested information, should the plaintiff have to verify the claims to me? In my answer to the summons I stated that I denied the statements contained in the petition filed by the plaintiff. Does the law firm handling the lawsuit have a time limit in providing this verification? Since I denied the statements contained in the petition and the law firm has to obtain verification of the debt and mail a copy to me, is it not against FDCPA statue Sec 809 [15 USC 1692g] for the law firm to continue with sending me a letter asking me to call to resolve this matter without undue work and expense. That was the cover letter to the request for admissions. The filed court house summons stated that all collection efforts, INCLUDING this lawsuit will cease. Would it not be a violation of the before mentioned statement for them to send me the letter for request for admissions? I have not received any verification information. What should I do?
